Yes you read that correctly, apparently in our country it’s ok to smother your innocent baby girl to death, and still walk free on bail.

Sofina Nikat, 24, smothered her 15-month-old baby at a park in Heidelberg West in April last year before rolling her body into a creek.

Her pre-sentencing hearing in the Victorian Supreme Court was told the Fijian-born mother told police she believed her daughter, Sanaya Sahib, was “possessed” and “would be in a better place”.

Nikat initially told police her baby had been snatched from her pram by a barefoot man of African appearance who smelled of alcohol.

But she later confessed, telling detectives she had lied because she was “shocked that she really did that to her baby, she couldn’t think straight”, the court was told.

Here’s the thing, we at FACAA don’t accept her claims that she was depressed and that’s why she killed her daughter, here’s why.

Firstly she outright lied about what happened to her. She tried the standard “drunken mystery barefoot blackman” did it defence. She knew what she did was wrong, she knew it enough to lie and make up a story and blame some mystery drunk blackman, yet she did it anyway.

Secondly she is now saying she thought her innocent 15 month old baby girl was possessed. She is even saying she was sent holy water by a Fijian priest to cleanse the child and rid her of the demon.

Ok so what was it Sofina ? Was it depression that made you kill your daughter or was it that the baby was possessed ? Because you can’t have it both ways. The fact is you killed your innocent daughter and now you’re scrambling for excuse after excuse !

But wait there’s more, of course that’s not all she has, she’s also playing the domestic violence card. Defence barrister Christopher Dane QC said Nikat had been a victim of domestic violence and was unable to cope living in a refuge with no financial or family support.

“We have a thoroughly unprepared child put into an arranged marriage, started OK, becomes the servant, becomes the criticised servant and the marriage breaks down,” he told the court. Mr Dane said two weeks before Nikat had been due to give birth, she had revoked intervention orders taken out against her estranged husband and his family in a vain hope of reconciling with him.

Nikat was initially charged with murder and indicated at her committal hearing earlier this year that she would plead guilty to infanticide, which carries a maximum penalty of five years’ imprisonment.

But it was not until this month that prosecutors agreed to downgrade the charge to infanticide a charge which carries a mere maximum penalty of 5 years.

Christopher Dane QC then argued that considering she had been behind bars for 18 months already she should be released on bail.

Sadly the judge agreed, why sadly because to us a child has been murdered and all the justice system seemed to be worried about was the welfare of her killer.

We are not saying that post partem depression is not a very real very debilitating thing, we are not saying that mental illness is not very real and very horrific. We are saying that there is no excuse, zero, zip, nada excuse for murdering a child. Not now not ever.

Our system needs to be less concerned with the welfare of child killers and more concerned with the fact that children are being killed ! (A)

Don’t worry about the people that criticise you, because when people judge you and assume that they know who you are by the stories others tell about you, they form a false images of you in their mind of who they think you are, seen only through the eyes of others, formed by the gossip people spread, the hearsay and half truth that grow like weeds, spreading even more weeds into the life of others. “A lie can travel half way around the world while the truth is putting on its shoes.”
Most people choose stability over freedom, many put up with being controlled, ruled and governed by others, which is a form of slavery, mostly because many fear the responsibility that goes with having to make real life decisions for themselves. Its our primal needs for food, water and shelter that drive our fears and these needs have always been the reason why so many people choose stability over freedom.
Like it or not, we all have unresolved issues from our childhood past, we all have a history that governs our actions, but we can’t heal our adult life when we refuse to face our childhood past.
We can’t change a thing from our past, even though we do see the flashbacks from there more clearly when we look back as the adult observer of all our childhood memories, and accept that its that past that has shaped us into who and what we are today, but there are still those who are fearful of their own past, and attack others with only half truths.

To save your own soul, you must leave whatever place or situation you are in, if love, respect, and truth are not served by you staying there, because if you remain, you become someone else.
I don’t really care what other people say about me when a child’s life is in the balance, because what if that child… was your child?
I am asked many questions and the answers I give are from my own life experiences, and because of my own childhood past, for me to keep doing this work each day, I need to be as honest with you, as I am with myself.
“Do you ever feel like giving up?” Yes, I do feel like giving up, especially when I am bombarded each day with stories that reflect my own childhood horror past, and I see that so many people in this modern society pretend to be asleep or blind to the truth of how prevalent child sexual abuse, incest, rape and sibling sexual abuse is in our community today.

As children bring their broken toys, with tears for us to mend, I brought my broken dreams to God, because He is my friend. But then instead of leaving Him in peace to work alone, I hung around and tried to help, with ways that were my own. At last, I snatched them back again and cried. “How can you be so slow?” “My child,” He said, “What could I do? You never did let go.”
We need to let go in order that those ingrained patterns, programs and conditioning from our childhood past no longer rule and control our adult lives or bring up more pain.
As adults survivors we have to retrain ourselves to be able to see value and worth in ourselves, but we have to first learn how to treat our self differently before others can.
Most people have only lived in accordance to the station to which they are born, unaware of the compounds that imprisoned him or her to their family’s old training and conditioning.
Many still follow the footsteps set by others, follow the crowd that is lead by trends, and only when we break out of the mould that was built for us, and see the truth that we are going to be faced with all kinds of persecution from others who still sleep.
I’ve learned over time that when people attack you, and don’t accept you for who you are, in expressing their protest of you they expose themselves.

Rarely do stories affect us at FACAA the way little Hemi’s story did, it could have been his curly black hair, it could have been his big brown eyes, it could have been his smile that would light up a room (quoted from his Dad the awesome Shane Burke) or it could have been the shocking injustice that befell him….. we simply don’t know what it was but this case hit us like a freight train.

Tonight we will not be discussing the crime or the perpetrator that took poor Hemi from his family and his mum and dad, Kerri-Ann and Shane.

Tonight his family have asked that our members join them in lighting a candle for little H-bomb and remembering the boy that was Hemi 🙂

We could not have said it better than his mother Kerri-Ann did when she wrote this poem for Hemi on his birthday.
